California Faculty Association Collective Bargaining

Please check out the link below that shows CFA is not willing to accept the 3-2-2 salary increases over the next three years. CFA is asking for 10%.

This is why we didn't accept the same proposal. The 3% salary reopener agreement still needs to be approved by the Board of Trustees at the November 12-13, 2014 meeting.

CSU General Salary Increase

Dear Brothers and Sisters,
I am happy to announce that we reached an agreement with the CSU on September 17, 2014 for 3% General Salary Increase, (GSI), in wages under the wage re-opener of the current contract, which expires in July of 2015. This increase will take effect retroactively to July 1st of this year and applied to all hours worked since that date for all Unit 6 classifications. Also, it will increase the minimums and maximums for every classification, so this will increase the rates for new hires as well as current employees.

The background to this is that under this wage re-opener, we could propose only changes in wages/salaries and for the last year of the current agreement, or we could also have proposed changes to the benefits section of our contract, which we declined to do. Our wage re-opener bargaining occurred against the background of full contract negotiations CSU is having with other unions, the Police, the Faculty and the CSUEU and the Student Counselors union. The CSU proposed to us a three-year agreement on wages, with a 3% increase this year, a 2% increase next year and another 2% GSI July 2016. This, they said, was the same deal they offered the Faculty where negotiations are continuing, and it appears the CEUEU and the Student Counselors already agreed to, (subject to membership ratification). They also offered that if we agreed to this, it would lock in those increases in subsequent years, something the current contract is not clear about.

SETC rejected the CSU's proposal on the grounds that we want to see how the faculty come out; their negotiations are continuing. Plus, I did not want to jump start negotiations for the new contract without a full participation of a broader bargaining committee than we have been able to bring to the table for these wage re-opener negotiations. So, for now, we'll settle for the 3% increase for 2014-2015, something which will take some of the pressure off our bargaining this coming year, which will start in February, and in which I intend to seek more than 2% increases for you. It is my belief that we are entitled to more; we keep the lights on, the classroom cool, (or warm), we hold the campus together, and our members, you and your colleagues, all could make substantially more in the private sector than other university employees.

So, let's enjoy this 3% increase, and start getting ready for intense contract negotiations starting in the New Year. For that purpose, we'll be holding meetings late in the fall, at each campus, to get together strong committees to demonstrate locally your strong belief that Trades employees at CSU, deserve more.

UCI Bargaining Update

The UCI bargaining team has been diligently working to augment our contract. So far, we have tentatively agreed to fourteen out of the forty nine articles within our contract. The pace has been somewhat slow, as our bargaining team has proposals on 45 of the 49 Articles, but, despite UCI's stated intentions at the table, they have not provided counter proposals they promised to provide [at one session promised 6 counter proposals, but only had one], and are reluctant to agree to the most fundamental changes, even when they admit they routinely, and without exception do what we're asking to put in writing, and yet, they do not want to commit their routine practice to writing. We have robust exchanges at the table, but, have yet to see much agreement from UCI. We are already essentially at impasse on several Articles as UCI has not budged, and we may have to start putting those Articles in a formal "Impasse pile" starting at the next meeting, August 8. Our goal is to change language that better protects our members, and most importantly, to gain a contract which is fair to our members and can be clearly understood to both sides. Most of what we have agreed to have been no change articles or minor syntax and/or spelling corrections. We'll keep you updated, on this website relative to progress toward a completed contract, or formal declaration of Impasse to PERB. We have three more scheduled dates for bargaining on August 8th,13th, and the 25th.

CSU Re-Openers for Salaries Requested

Dear Brothers and Sisters,
On April 30, 2014, SETCU requested CSU re-openers for salaries (Article 24) for the fiscal year 2014/2015 pursuant to Article 24 of our CBA.

What follows is a time line of responses since our request.

In an effort to keep you all informed of what's going on in your Union, we will be making a greater effort in posting current events and information on our website. I appreciate your patience and continued support.

Over the next several months, we will be getting extremely busy with not only the CSU re-openers for salaries but we will be coming into sunshining for the CSU contract. I encourage all Unit 6 members to take an interest in these issues and feel free to make suggestions or forward any information that you feel would benefit our goals of increasing our salary structure and making our contract stronger. For instance, at one of the CSU campuses, they are having an issue with CTO and how management utilizes it to their advantage. On another campus, it's their interpretation of how and when we can use vacation or sick leave, and you may be having an issue with the continuous and ongoing problem of working out of classification not to mention the contracting out of Our Work!

All of these if not more may be happening on your campus and we may or may not know about it. So by sharing amongst ourselves relevant issues and information we will be helping ourselves become United and Stronger which is what they don't want. So let's not give them what they want!

2014 Scholarship Recipients

We'd like to thank you all for submitting your scholarship application essays. As much as we would like to fund all of the 74 scholarship applications we received, unfortunately we can only fund 40. Applicants who did not receive a scholarship in the last two years and applied again this year are given priority selection.

The following scholarship applicants will receive $500 (checks will be mailed out the first week of June) from the SETC-United John R. Connor Memorial Scholarship Fund for 2014. The SETC-United Memorial Scholarships are made possible by a generous commitment from the members of SETC-United who all donate a portion of their member dues to provide permanent scholarship support to students like you, every year.

Congratulations again on being selected and best of luck to you as you continue your studies. We look forward to hearing of your success!

2013/2014 SETCU-CSU Contract Re-opener

The CSU Board of Trustees has approved a 1.34% salary increase for all Unit 6 members in active status, or on leave, as of July 1, 2013. The increase shall be paid pro-rata for employees who are less than full time.

All Unit 6 salary range minimums and maximums for all classifications shall be increased by 1.34%. These changes shall be effective July 1, 2013.

The general salary increase shall be effective July 1, 2013.

Dear Members:

On Thursday, October 10th, the ballots for all SETC-United Officers and Board Members were counted in by a third party election company retained by the Executive Board to conduct this election, True Ballot, Inc. In accordance with SETCU's Election Rules, which are available at this link, http://www.setc-united.org/pdf/Election_Posting_No3.pdf, persons wishing to challenge the election results on account of an alleged violation of the Election Rules may do so up until the close of business on the tenth (10th) calendar day following this posting of the election results. Accordingly, an election challenge or protest must be filed by the close of business, 5 PM, on Thursday, October 24. Note that the election rules expressly state the time limit for filing an election protest will be strictly construed and that an election protest "must include a detailed statement of the reasons for the election protest and the names and contact information of individuals who purportedly have information supporting the election protest or other relevant information or it is subject to be summarily dismissed." These are initial proposals that, by law, need to be "sunshined" to the public (which means the public has a right to know what we are asking for and has a right to make comments about the proposals). Brothers and Sisters,

In an ongoing effort to keep our union with a finger on the pulse of what's happening on our campuses, we have created the first of many surveys to come. In doing this, we will be able to address issues that you may see as being only on your campus, but with collective information we may realize it's developing into a global issue or there's a pattern developing that we would be able to address before it becomes a problem. Such as, with the Facilities Project Supervisor position on a lot of our campuses.

So in future surveys we are going to want to start looking at the classification standards and if they are being maintained according to the Standards developed by SETC and the CSU. Helping to correct and prevent working out of classification issues.

Also, we will start looking at ways that we could make what you do easier and give you the training and necessary tools to help you become more effective in representing our members. And also ways that we can show our appreciation for the thankless job that you do as a Stewards.

Victory in Wrongful Termination Case

Dear SETCU Brothers and Sisters:

It is with great pleasure to announce a huge victory for SETC-United by Fred Quiel, SETCU attorney and Karl Chan, UCLA Chief Steward, and Gary Comer, Executive Board Member/UCLA Chief Steward, after long hours of documentation, many, many briefings, phone calls and a whole of lot of time put in preparing for the arbitration hearings for Felton Pollard, UCLA member, for wrongful termination.

Felton Pollard's termination was reduced to a six-month suspension and he is to be immediately reinstated to his former position of employment, back to his original shift and work schedule assignment when discharged, with full back pay, benefits, and seniority less any interim earnings for all time lost from the end of the disciplinary suspension to reinstatement.

On behalf of SETC-United, congratulations Fred & Gary for a job well done in representing our members!

In Memory of Randy Grobe

Dear Brothers and Sisters:

It is with a sad heart that I bring to you the news that Randy Grobe has passed. Many are saddened by his passing but we rejoice with his family in the knowledge that he accomplished many things in life that most people only dream about. He was a leader and a strong advocate of labor. His many years of service to the union movement helped propel SETC-United into the 21st century. He was on many contract bargaining committees, apprenticeship committee, and spent many years on the Board as an Executive Board member, and business manager. He also started our original web page and was known as the "Webmaster."

His latest assignment was the "Global Contracting Out" grievance, which took many of his hours, days and months to prepare. He diligently took on this assignment and through his meticulousness to detail greatly enhanced the Union's position. But this last great challenge will be left for others to finish.

Randy, your contributions to this union will not be forgotten, your sacrifices will not be in vain. SETC-United will carry on the good fight. Thank you for your service...

Applicants who did not receive a scholarship last year and applied again this year are given priority selection.

The following scholarship applicants will receive $500 (checks will be mailed out on June 1, 2013) from the SETC-United John R. Connor Memorial Scholarship Fund for 2013.

The SETC-United Memorial Scholarships are made possible by a generous commitment from the members of SETC-United who all donate a portion of their member dues to provide permanent scholarship support to students like you, every year.

Victory in Wrongful Termination Case

Dear SETCU Brothers and Sisters:

It is with great pleasure to announce a huge victory for SETC-United by Fred Quiel, SETCU attorney and Karl Chan, UCLA Chief Steward, and Gary Comer, Executive Board Member/UCLA Chief Steward, after long hours of documentation, many, many briefings, phone calls and a whole of lot of time put in preparing for the arbitration hearings for Felton Pollard, UCLA member, for wrongful termination.

Felton Pollard's termination was reduced to a six-month suspension and he is to be immediately reinstated to his former position of employment, back to his original shift and work schedule assignment when discharged, with full back pay, benefits, and seniority less any interim earnings for all time lost from the end of the disciplinary suspension to reinstatement.

On behalf of SETC-United, congratulations Fred & Gary for a job well done in representing our members!

In Memory of Randy Grobe

Dear Brothers and Sisters:

It is with a sad heart that I bring to you the news that Randy Grobe has passed. Many are saddened by his passing but we rejoice with his family in the knowledge that he accomplished many things in life that most people only dream about. He was a leader and a strong advocate of labor. His many years of service to the union movement helped propel SETC-United into the 21st century. He was on many contract bargaining committees, apprenticeship committee, and spent many years on the Board as an Executive Board member, and business manager. He also started our original web page and was known as the "Webmaster."

His latest assignment was the "Global Contracting Out" grievance, which took many of his hours, days and months to prepare. He diligently took on this assignment and through his meticulousness to detail greatly enhanced the Union's position. But this last great challenge will be left for others to finish.

Randy, your contributions to this union will not be forgotten, your sacrifices will not be in vain. SETC-United will carry on the good fight. Thank you for your service...

2012-2014 SETCU/UCI & 2012-2015 CSU Contracts

Happy New Year Brothers & Sisters,

We are delighted to report that the first SETCU/UCI Contract 2012-2014 has been posted under "UC System" tab. Click here to view the PDF. The contract is ready to go to print with the exception of Appendix B (signature page).

The CSU Contract for 2012-2015 was delivered to all Stewards at the CSU campuses this past December. The CSU Contract has also been posted on our website under "CSU System" tab. Click here to view the PDF.

As a reminder, the next Quarterly General Membership meeting is scheduled for Saturday, January 26, 2013 at Cal Poly Pomona. Please refer to upcoming general membership meetings for details. UCSD MOU Ratified by Membership Vote!

Congratulations UCSD on the successful ratification of your new Collective Bargaining Agreement. The overwhelming support held at the ratification vote on Friday, October 12, 2012 is a testament to the hard work and determination of your Negotiating Committee in obtaining valuable job protections and wage increases. The vote was 134 yes, 0 no.

Over the next several months, the new MOU will be proofed from TA'd articles and/current contract language for final content and posted on the website. SETCU will be printing enough copies for all members.

UCLA Reduction in Time PERB Decision - Congratulations to SETCU!

UCLA brothers and sisters, as you will read, the PERB decision totally agrees with our position the University had no right to impose the RIT. The Judge sided with us in every important respect. This is now one of the only cases on record where PERB has found an employer to have engaged in direct dealing, and then on top of it, he found that UCLA discriminated against the union, changed terms unilaterally instead of bargaining in good faith, failed to provide information, etc. Critically, he declined UCLA's request to defer the arbitration or otherwise limit the remedy. Instead, barring reversal on appeal, UCLA owes everyone affected by the RIT every penny that they haven’t already paid them, just as we requested.

UCLA has 20 days to file exceptions with the Board. From there, UCLA could take it to the court of appeals so the battle is not over. We will keep you posted when we know more about how UCLA responds.

SETC-United/UCSD Contract Negotiations Update

Hello Brothers and Sisters,

We are very pleased to announce that Tom Trooien, Chief Negotiator and the SETC-United/UCSD Bargaining Team have reached a tentative memorandum of understanding in contract negotiations. This has been a very long and difficult task. The negotiating team has fought long and hard to maintain the protections and security this contract provides for our members. With the combined efforts, patients and willingness to keep coming back when things looked less than promising, our members on the negotiating team, Eduardo Rosales, Larry Octon, Harry Heaps, Dave Rogers and Tom Trooien, Chief Negotiator were able to eventually reach an agreement.

This is Tom Trooien's third contract negotiated for SETCU and we are very fortunate to have him representing SETCU in negotiations along with all of the many other jobs he does for SETC-United. As the Business Manager for SETC-United, I would like to say it was my honor to be a small part in these negotiations and witness the real care, concern and dedication these team members had in representing the members. SETC-United is very proud of their accomplishments and I would like to thank them for their willingness to step up and take this on. This is the type of participation that makes SETC-United strong. Thanks guys!

CSU Unit 6 Skilled Tradesworkers Overwhelmingly Ratifies Tentative Collective Bargaining Agreement!

CSU Unit 6 skilled tradesworkers turned out in large numbers during the last week and a half across the state to review and vote on their proposed contract. The results were: 542 members voted in favor of ratification and 73 members rejected the contract.

I would like to thank all the members who attended the ratification meetings to obtain clarification and cast their vote on the TA'd contract that was presented at the meetings. I would also like to thank the various board members and all the campus stewards that helped make this ratification possible.

The four-year tentative CBA now goes before the CSU Board of Trustees next week for ratification.

RIT Settlement Agreement between SETC-United and Regents of UCSD

Brothers / Sisters:

SETC had a BIG day yesterday! Finally, we have a settlement on our reduction-it time (RIT) case! The arbitrator has issued his decision supporting our claim that the RIT was not done properly according to seniority order. As a result, in some late evening negotiations (January 18, 2012), SETC came to an agreement with UCSD for the following award to our members:

Full restoration of benefits that were reduced during the RIT that took place in 2009/2010. All sick time, vacation time, and retirement benefits that were reduced will be restored to all affected members.

Cash payment of $0.70/dollar that was lost due to the RIT. This is huge! This is a bigger payout than any other campus got by 20%, and represents significant negotiation on the part of your union, our legal counsel at Leonard- Carder, and UCSD. UCSD has committed making a good faith effort to issue payments within 30 - 40 days.

As expected, we did lose on several key issues related to the RIT case. Namely, our right to challenge the grounds for the RIT and layoffs was denied and those individuals that were laid-off have no further recourse or part in this settlement. As a Union, concerned about the rights of all members, this was particularly hard to swallow. Even late into the negotiation last night, SETC negotiators worked hard to get something for those members as well, but were unsuccessful. Our thoughts go out to those members and we wish them well in their futures.

It is important to recognize the efforts of several Union members who worked tirelessly to achieve this decision. Eduardo Rosales our Chief Steward, and Harry Heaps (Co-Chief Steward - Med Center) volunteered endless hours on your behalf even though they personally will not benefit from this settlement. Dave Rogers (FM-Carpenter) assisted in negotiations and spent many unpaid hours working for this result. Our consultant, Tom Trooien, and current Business Manager, Herb Dickerson, also worked diligently to achieve this end and continue to work on our behalf in collective bargaining. Matt Ross (Leonard Carder) who directed our legal efforts, and Kate Hallward (Leonard Carder) who was instrumental in negotiating this settlement, all deserve your thanks.

Lastly, a "shout-out" to Pat Hallahan and the late John Connor is also appropriate. Pat told us from the beginning that UC's actions were wrong and gave us the strength to stand up to the UC machine. John Connor, many believe, gave his life for this Union and this particular effort. It is believed by many that it was the stress of this issue and the personal weight and responsibility for our members that he felt as Business Manager, that triggered his heart attack and untimely death. Thanks to Pat and John!

IMPORTANT MESSAGE TO UC IRVINE BROTHERS AND SISTERS FROM EXECUTIVE BOARD MEMBER, NEAL EDWARDS:

I spoke to Carl Smith on Friday and he stated that payroll sent him a spreadsheet late last week for the errors that occurred with the reduction in time payment. Unfortunately, the error was different for most individuals. Carl is thinking about the best way to distribute the information while protecting individual's privacy. The correction is supposed to come on the May 1st check.

The back pay part of the agreement should also be part of the May 1st check. So there should be two lump sum payments on the next check.

I have continually stated to Labor Relations that our members need an accounting of your payments. As we are given information, we will pass it on.

CSU Fullerton Grievance Settlement

A level two grievance was settled for the carpenter shop, over work that was done in the bookstore. The carpenter shop, members, Tom, Joe, Dave, Ernie, and Gianni, will be receiving a payment for 16 hours of labor each at an O.T. rate (80 man hours total awarded to the shop).

SETC-United President Nominated

Nominations for President were held on Saturday, January 7, 2012, at the Hampton Inn in Merced.

John Howard from SLO and John Lemos from Stanislaus were the only two nominees nominated for President of SETC-United. A total of 39 members attended and voted. John Howard received 25 votes, John Lemos received 14 votes.

Congratulations to John Howard who will serve as President for the remainder term of office until October 31, 2013.

Thank you for those members who went out of their way to arrange your weekend schedule to attend this very important meeting on Saturday.

San Francisco State Grievance Resolution

Congratulations to David Hagstrom (newly appointed last summer) and Mario Diaz, Co-Chief Stewards at San Francisco State for their efforts in resolving 9 grievances resulting in a cash settlement of $625.00 for 49 members at San Francisco State. The 49 members received their settlement check just yesterday.
